Los abogados árabes del caso de custodia compartida del español Borja Brañanova hacen historia en la justicia de Dubai

Ha sido un logro histórico. A comienzos de este año el ingeniero español afincado en Dubai Borja Brañanova consiguió que los tribunales de Emiratos Árabes Unidos (EAU) le concediesen la custodia compartida de sus hijos en una decisión pionera en el mundo árabe. Lo hizo con la ayuda de dos abogados, el emiratí Mukhtar Al Gharib y el sirio Ahmad Al Rajjoub, que han analizado para EL CORREO DEL GOLFO, en una entrevista exclusiva, las implicaciones que una sentencia como esta tiene para la jurisprudencia islámica.

Al Rajjoub asegura que el caso de Brañanova ha dejado “un gran impacto positivo” a la hora de avanzar en un objetivo al que, tanto él como su socio Al Gharib, han dedicado un intenso esfuerzo profesional a lo largo de sus años de ejercicio: dar un lugar preferente al interés de los menores en las disputas familiares. “Estoy seguro de que la sentencia de este juicio marcará el cambio en el sistema judicial de los tribunales de EAU en relación con la custodia de los niños”, valora Al Gharib.

En 2013 Borja Brañanova se casó con una sudafricana en Emiratos Árabes Unidos y del matrimonio nacieron dos hijos. Tres años después ella presentó una demanda de divorcio y comenzó un largo litigio por los niños. La ex mujer de Brañanova consiguió la custodia en el Tribunal de Primera Instancia de Dubai, que aplicó la ley emiratí en el proceso.

Brañanova entendió entonces que tenía que luchar para que, atendiendo a la nacionalidad de los pequeños, se aplicase la ley española y, de la mano de Al Gharib y Al Rajjoub, logró que el Tribunal de Casación lo hiciese y que, en base a ella, adoptase una decisión sin precedentes, la de la primera custodia compartida decretada en los tribunales emiratíes.

La Sharia islámica, que se considera la fuente de la legislación, no impide el desarrollo de disposiciones de custodia, ya que todas las religiones celestiales exigen la protección del niño y cuidan sus intereses

El abogado sirio afirma que desde que aceptaron el caso del ingeniero español supieron que Brañanova “no era como otros clientes”, ya que demostraba un “interés extraordinario” en la causa. Brañanova “desempeñó un papel clave al proporcionar varios documentos para persuadir a la Corte de que la Ley española da prioridad a la custodia compartida”, apunta Al Gharib.

Cargados con “grandes cajas” repletas de documentos que implicaron en el caso a todo el personal del Tribunal de Familia emiratí, los abogados emprendieron un trabajo “agotador” que entendieron como “un gran desafío”, según Al Gharib, director del bufete de abogados.

“Me pareció una oportunidad para realizar mi aspiración personal de cambiar algunos artículos de la Ley de Estado Personal de los Emiratos”, explica el abogado dubaití, que lucha desde hace años para conseguir que los niños sufran los menores perjuicios posibles en el proceso de divorcio de sus padres.

Mukhtar Gharib, nacido en 1968 en Dubai, se interesó desde el principio de su ejercicio por el derecho familiar. Miembro de la Asociación de Derechos Humanos de Emiratos Árabes Unidos, Al Gharib ha destacado por su defensa de los derechos históricos y ha conseguido firmar una serie de sentencias pioneras en el mundo árabe, como la primera custodia a un padre adoptivo o la que por primera vez reconoció el parentesco de un cristiano como padre del hijo nacido en un matrimonio con una mujer musulmana.

Actualmente, la ley emiratí otorga a las madres la custodia de los hijos menores de edad hasta los once años, en el caso de los varones, o hasta los trece años, en el caso de las niñas. Posteriormente, la custodia se transfiere a los padres. Durante el período de custodia, el padre puede ver a sus hijos solo durante unas pocas horas cada una o dos semanas. De manera similar, después del final de su custodia, la madre solo puede ver a sus hijos durante algunas horas cada semana.

Estamos convencidos de que la responsabilidad de los niños debe ser compartida entre los dos padres

Tanto Al Gharib como Al Rajjoub consideran que esta jurisprudencia debe cambiar. “Estamos convencidos de que la responsabilidad de los niños debe ser compartida entre los dos padres”, sostiene el abogado sirio. La custodia compartida, añade Al Gharib, “se considera verdaderamente uno de los derechos del niño”.

La clave para entender el éxito de esta causa reside en el hecho de que los letrados han demostrado que la custodia compartida no contraviene la ley islámica sagrada sino la jurisprudencia árabe. Por ello, defienden, es posible dictaminar la custodia compartida, una medida que sí está recogida en la legislación española y que, según los abogados, debería recogerse también en la jurisprudencia emiratí porque la Sharia no es contraria a ella.

Al Gharib explica que hay que diferenciar entre la regla de la Sharia, que cita directamente el Corán y las enseñanzas del Profeta, y la de la jurisprudencia, que se manifiesta en cualquier disposición hecha por cualquier musulmán y que “puede ser vulnerable, falible y no permanente, porque refleja la opinión de un hombre que se consideró aceptable y se aplicó en ciertas circunstancias que pueden cambiar”. Entre estas normas susceptibles de modificación Al Gharib cita la Ley Nº 28 de 2005 del Estatuto Personal, que regula la concesión de la custodia en Emiratos Árabes Unidos.

Es posible discutir para establecer una regla que sea compatible con las circunstancias actuales de la sociedad en el marco de la respetable Sharia, la ley y los acuerdos internacionales suscritos por el Estado de Emiratos Árabes en las Naciones Unidas

El abogado explica que existe “el derecho de discutirla para establecer la regla que sea compatible con las circunstancias actuales de la sociedad en el marco de la respetable Sharia, la ley y los acuerdos internacionales suscritos por el Estado de Emiratos Árabes Unidos en las Naciones Unidas”.

La ley de familias, insiste Al Gharib, “no incluye disposiciones definitivas y decisivas de la Sharia que regulen las cuestiones de custodia”. Es más, puntualiza Al Rajjoub, “la Sharia islámica, que se considera la fuente de la legislación, no impide el desarrollo de disposiciones de custodia, ya que todas las religiones celestiales exigen la protección del niño y cuidan sus intereses”.

Por todo ello, valora el abogado, “tales discreciones y opiniones jurisprudenciales se pueden cambiar y modificar para que sean compatibles con la situación actual, ya que la soberanía moral es más amplia que la soberanía de la ley, y la inmunidad real de las naciones está representada en la moral, el trato amable y la felicidad”.

En definitiva, expone Al Gharib,  “cualquier ley que rija las relaciones familiares debe basarse en los principios de honestidad, transparencia, dignidad, perdón, favor, solidaridad, misericordia y sinceridad entre ellos y todos se sentirán seguros de su estabilidad psicológica, especialmente los niños”.

Además, remarca Al Gharib, “es bien sabido que el Estado de Emiratos Árabes Unidos presta gran atención a la familia, independientemente de si se trata de una familia emiratí o de una familia que reside en su territorio, porque el Estado reconoce que la familia es el núcleo de cualquier sociedad y busca hacer justicia a la familia en disputas judiciales”. Ese es el motivo por el que el Estado otorga a los extranjeros el derecho de aplicar la ley de su nacionalidad a sus disputas familiares, una concesión que, en este caso, ha resultado crucial para el éxito de la causa.

AMPLIA REPERCUSIÓN

Los abogados de Brañanova consideran que la victoria lograda en este caso tendrá una importante repercusión de cara al futuro. “Es muy posible aprovechar la sentencia que fue apoyada por el Tribunal de Casación, que es la máxima autoridad judicial en Dubai, en otros casos propuestos ante los tribunales en el Estado de los Emiratos Árabes Unidos”, dice Al Gharib.

De hecho, los abogados están dando un paso más y están pidiendo custodia compartida en casos de ciudadanos árabes a pesar de que no existe una cláusula especial sobre ella en la ley emiratí. Para poder hacerlo, Al Gharib y Al Rajjoub se están apoyando en una cláusula mencionada en la ley, según la cual el juez siempre debe emitir una sentencia que sea compatible con el interés del menor bajo custodia.

La custodia compartida decretada en el caso de Brañanova, incide Al Rajjoub, es una “idea nueva” que se debe proponer para el futuro. De hecho, el bufete espera ahora otra sentencia en la que creen que la medida puede ser aplicable en base a sus argumentos. Sin embargo, el letrado es consciente de que un fallo favorable “es poco probable debido a la falta de cultura de custodia compartida en la judicatura y las comunidades árabes”.

En este sentido, los letrados recuerdan que fue la ausencia de una referencia a la custodia compartida en la Ley del Estatuto Personal la que tumbó la petición de custodia compartida en el Tribunal de Primera Instancia. Este hecho, señala Al Rajjoub, “prueba que hay una necesidad de cláusulas legales en las leyes árabes que establezcan la regulación de la custodia conjunta de ambos padres para sus hijos después del divorcio”.

Al Rajjoub ya era conocedor de las disposiciones legales españoles respecto a la custodia antes de implicarse en el caso de Brañanova. En 2011, a raíz de la crisis en Siria que se convirtió en un conflicto armado, Al Rajjoub trabajó para fundaciones caritativas para ayudar a las familias afectadas por la guerra en Alepo y, en 2015, se trasladó a Emiratos Árabes Unidos, donde empezó a trabajar con Mukhtar Gharib. El abogado es autor de la obra ‘Disposiciones de la custodia de los niños en las leyes árabes y extranjeras’, en la que recoge y analiza 19 modelos de cláusulas de custodia de leyes árabes y dos modelos pertenecientes a leyes extranjeras, entre ellos, la española. 

En su obra, Al Rajjoub hace un llamamiento “a los padres y a los países para que presten atención al menor y se promulguen leyes nuevas y actualizadas para preservar mejor los derechos e intereses del menor”. Además, el libro ilustra los puntos positivos en la legislación de Emiratos Árabes Unidos y destaca entre ellos el que ha resultado vital para el éxito del caso de Brañanova, el hecho de que los extranjeros puedan solicitar al tribunal que apliquen la ley de su nación en disputas familiares.

Asimismo, el abogado sirio apuesta por el establecimiento de “una nueva cultura, especialmente en los países árabes, sobre el concepto de custodia, representado en la búsqueda del mejor interés para el menor de edad sin dar preferencia a ninguno de los padres en custodia sobre el otro según los requisitos de interés del menor”.

Entre los diferentes aspectos que necesitan una revisión, Al Rajjoub considera que “la visita de los padres a sus hijos debe ser modificada porque, de acuerdo con las leyes vigentes, el padre no custodio recibe pocas horas a la semana para visitar a sus hijos y, de manera similar, las leyes actuales pueden privar a la madre de sus hijos en una edad específica, cuando solo podrán verlos durante unas pocas horas”.

A pesar de que encontró diferencias entre las legislaciones árabes analizadas en su estudio, el letrado determinó que “todas esas legislaciones están restringiendo el juicio en muchos aspectos y puede que no permitan emitir un juicio en línea con el interés del niño”.

Por ello, a juicio de Al Rajjoub, “las legislaciones europeas se consideran más apropiadas para permitir que el juez emita un fallo que esté en línea con el interés del menor”. Como ejemplos cita las leyes francesa y española que “no distinguen entre ambos padres mientras asignan la custodia, excepto en los asuntos que se consideran para el mejor interés del niño”.

Aunque consciente de las dificultades, Al Rajjoub ve esperanza en el camino futuro y prepara otro libro en el que ahondará en el tema de la custodia compartida. El primer libro, afirma, obtuvo “un gran apoyo moral de varias autoridades judiciales, legales y gubernamentales y aliento sobre las ideas propuestas para actualizar las disposiciones de custodia”. De hecho, la obra recibió el visto bueno de las autoridades oficiales de Emiratos Árabes Unidos y de Siria para su impresión y distribución.

La histórica victoria en los tribunales de Dubai no ha sido la única recompensa que Al Gharib y Al Rajjoub han obtenido al defender el caso de Brañanova. La Confederación por el Mejor Interés de la Infancia de España propuso la candidatura de Borja Brañanova y todo su equipo de abogados al Premio Princesa de Asturias de la Concordia tras obtener la primera custodia compartida en el país emiratí. Los abogados recibieron la nominación con sorpresa y satisfacción. “Nos encantó esta noticia y reconocimos que hay personas que aprecian los grandes esfuerzos”, dice Al Rajjoub.

Lograda la custodia, el español Borja Brañanova está más cerca de lograr el que ha sido uno de los mayores deseos desde que nacieron sus hijos, llevarles de vacaciones a España. Hasta este momento no ha conseguido la autorización para hacerlo. Ahora, sus abogados no creen que tenga problemas para obtener luz verde. Al Gharib cree que después de que la madre de los niños haya perdido la demanda “será más flexible para llegar a un acuerdo entre ambas partes para distribuir los días de custodia y los viajes entre ellos”.

It has been a historic achievement. Earlier this year the Spanish engineer settled in Dubai, Borja Brañanova, got the concession from the courts of the United Arab Emirates (UAE) of the joint custody of their children, a pioneer decision in the Arab world. He did it with the help of two lawyers, the Emirati Mukhtar Al Gharib and Ahmad Al Rajjoub from Syria, who had analyzed the implications of a judgement of this nature for the Islamic jurisprudence in an exclusive interview for EL CORREO DEL GOLFO.

Al Rajjoub says that the case of Brañanova has left "a great positive impact" when it comes to move forward on achieving the objective that both, he and his partner Al Gharib, have set by dedicating an extensive professional effort throughout their years of exercise: working for securing a preferential treatment for the minors best interest in the family disputes. "I am sure that the ruling of this trial will be a referent milestone for the change in the judicial system of the UAE courts in relation to the custody of children," says Al Gharib.

In 2013 Borja Brañanova married a South African woman in the United Arab Emirates and from their marriage two children were born. Three years later she filed for divorce and started a long litigation for the children. The former wife of Brañanova got sole custody in the Court of First Instance of Dubai, which applied the Emirati law in the process.

Brañanova understood then that he had to litigate so, according to the nationality of the children, the Spanish law would be applied and with the support of Al Gharib and Al Rajjoub, he convinced the Court of Cassation to do it and, based on it, adopt an unprecedented decision, that is the first joint custody issued in the Emirati courts.

The Syrian lawyer states that since they accepted the case of the Spanish engineer, they knew that Brañanova "was not like other clients", as he showed an "extraordinary interest" in the case.

Brañanova "played a key role by providing several documents to persuade the Court that Spanish law gives priority to the joint custody," Al Gharib affirms.

Loaded with "big boxes" full of documents that involved all the Emirati Family Court personnel on the case, the lawyers undertook an "exhausting" work that they understood as "a great challenge", according to Al Gharib, director of the law firm.

"I thought it was an opportunity to achieve my personal aspiration for changing some articles of the UAE Personal Status Law" explains the Emirati lawyer, who has been fighting for years to get the children to suffer the least possible damage from their parents divorce process.

Mukhtar Gharib, born in 1968 in Dubai, was interested from the beginning of his exercise on family law. A member of the Human Rights Association of the United Arab Emirates, Al Gharib has stood out for its defense of historical rights and he has managed to sign a series of pioneering sentences in the Arab world, such as the first custody of an adoptive father or the first once recognized kinship of a Christian as the father of the child born in a marriage with a Muslim woman.

Currently, the Emirati law grants mothers the custody of children under the age of eleven years, in the case of boys, or up to thirteen years, in the case of girls. 

Subsequently, the custody is transferred to the fathers. During the custody period, the father can see his children only for a few hours every one or two weeks. Similarly, after the end of their custody, the mother can only see her children for a few hours each week.

"We are convinced that the children responsibility must be shared between the two parents"

Both Al Gharib and Al Rajjoub believe that this jurisprudence should change. "We are convinced that the responsibility of the children should be shared between the two parents," says the Syrian lawyer. Joint custody, adds Al Gharib, "is truly considered one of the rights of the child".

The key for understanding the success of this case lies in the fact that the lawyers have shown that the joint custody does not contravene the sacred Islamic law and only challenge the arab jurisprudence.

Therefore, they defend that it is possible to rule on joint custody, a measure that is included in Spanish legislation and that, according to lawyers, should be also included in the Emirati jurisprudence because the Sharia is not contrary to it.

Al Gharib explains that it is necessary to differentiate between the rule of Sharia, which directly cites the Qur'an and the teachings of the Prophet, and that of jurisprudence, which manifests itself in any disposition made by any Muslim and that "may be vulnerable, fallible and not permanent, because it reflects the opinion of a man that was considered acceptable and applied in certain circumstances that may change. " Among these rules susceptible to modification Al Gharib cites Law No. 28 of 2005 of the Personal Statute, which regulates the granting of custody in the United Arab Emirates.

The lawyer explains that exists "the right to discuss it to establish the rule that is compatible with the current circumstances of the society within the framework of the respectable Sharia, the law and the international agreements signed by the State of the United Arab Emirates in the United Nations".

The family law, insists Al Gharib, "does not include definitive and decisive provisions of the Sharia that regulate custody issues." Moreover, Al Rajjoub points out, "Islamic Sharia, which is considered the source of legislation, does not prevent the development of custody provisions, since all celestial religions demand the protection of the child and take care of their interests".

For all this, assesses the lawyer, "such discretions and jurisprudential opinions can be changed and modified to be compatible with the current situation, since moral sovereignty is broader than the sovereignty of the law, and the real immunity of nations is represented in morals, kind treatment and happiness".

Ultimately, says Al Gharib, "any law that governs family relationships must be based on the principles of honesty, transparency, dignity, forgiveness, favor, solidarity, mercy and sincerity among them and everyone will feel confident of their psychological stability, especially the children".

In addition, Al Gharib points out that "it is well known that the State of the United Arab Emirates pays great attention to the family, regardless of whether it is an Emirati family or a family that resides in its territory, because the State recognizes that the family it is the core of any society and seeks to do justice to the family in judicial disputes. " That is the reason why the State grants foreigners the right to apply the law of their nationality to their family disputes, a concession that, in this case, has been crucial for the success of the cause.

WIDE IMPACT

Brañanova's lawyers consider that the victory achieved in this case will have an important impact in the future. "It is very possible to take advantage of the ruling that was supported by the Court of Cassation, which is the highest judicial authority in Dubai, in other cases brought before the courts in the State of the United Arab Emirates," says Al Gharib.

In fact, the lawyers are taking a step further and are asking for joint custody in cases of Arab citizens even though there is no special clause about it in the Emirati law. In order to do so, Al Gharib and Al Rajjoub are leaning on a clause mentioned in the law, according to which the judge must always issue a judgement that is compatible with the interest of the child in the custody.

The joint custody decreed in the case of Brañanova, says Al Rajjoub, is a "new idea" that must be proposed for the future. In fact, the firm now waits for another ruling in which they believe that the measure may be applicable based on their arguments. However, the lawyer is aware that a favorable ruling "is unlikely due to the lack of shared custody culture in the judiciary and the Arab communities".

In this sense, the lawyers remember that it was the absence of a reference to joint custody in the Personal Status Law that overturned the petition for joint custody in the Court of First Instance. This fact, says Al Rajjoub, "proves that there is a need for legal clauses in Arab laws that establish the regulation of joint custody of both parents for their children after divorce".

Al Rajjoub was already aware of the Spanish legal provisions regarding custody before getting involved in the Brañanova's case. In 2011, following the crisis in Syria that became an armed conflict, Al Rajjoub worked for charitable foundations to help families affected by the war in Aleppo and, in 2015, he moved to the United Arab Emirates, where he started work with Mukhtar Gharib. The lawyer is the author of the work 'Provisions of the custody of children in Arab and foreign laws', in which he collects and analyzes 19 models of custody clauses of Arab laws and two models belonging to foreign laws, among them, the Spanish.

In his work, Al Rajjoub calls on "parents and countries to pay attention to the child and enact new and updated laws to better preserve the rights and interests of the child." In addition, the book illustrates the positive points in the UAE legislation and highlights among them the one that has been vital for the success of Brañanova's case, the fact that foreigners can request the court to apply their nation's law in family disputes.

Also, the Syrian lawyer is committed to the establishment of "a new culture, especially in Arab countries, on the concept of custody, represented in the search of the best interest of the minor without giving preference to any of the parents in custody over the other according to the requirements of interest of the minor".

Among the different aspects that need a revision, Al Rajjoub considers that "the visit of the parents to their children must be modified because, according to the laws in force, the non-custodial father receives few hours a week to visit his children and similarly, current laws can deprive the mother of her children at a specific age, when they can only see them for a few hours".

Although he found differences between the Arab legislations analyzed in his study, the lawyer determined that "all those laws are restricting the trial in many aspects and may not allow a judgment to be issued in line with the child's interest".

Therefore, according to Al Rajjoub, "European laws are considered more appropriate to allow the judge to issue a ruling that is in line with the interest of the child." As examples he cites the French and Spanish laws that "do not distinguish between both parents while assigning custody, except in matters that are considered to be in the child's best interest".

Although aware of the difficulties, Al Rajjoub sees hope in the future path and prepares another book in which he will go deeper into the issue of shared custody. The first book, he says, obtained "great moral support from various judicial, legal and governmental authorities and encouragement on the proposed ideas to update the custody provisions." In fact, the work was approved by the official authorities of the United Arab Emirates and Syria for printing and distribution.

The historic victory in the Dubai courts has not been the only reward that Al Gharib and Al Rajjoub have obtained in defending Brañanova's case. The Confederation for the Best Interest of Children in Spain proposed the candidacy of Borja Brañanova and her entire team of lawyers to the Princess of Asturias Award for Concord after obtaining the first joint custody in the Emirati country. The lawyers received the nomination with surprise and satisfaction. "We loved this news and we recognized that there are people who appreciate the great efforts," says Al Rajjoub.

Once custody has been obtained, Spaniard Borja Brañanova is closer to achieve what has been one of the greatest wishes since his children were born, taking them on vacation to Spain. Until now he has not obtained the authorization to do so. Now, his lawyers do not think he has problems getting the green light. Al Gharib believes that after the children's mother has lost the demand "it will be more flexible to reach an agreement between both parties to distribute the days of custody and travel between them".

المحامون العرب يسطرون إنجازاً تاريخياً بساحة القضاء الإماراتي في قضية الحضانة المشتركة للمواطن الإسباني بورخا برانانوفا

أكد المحاميان مختار غريب وأحمد الرجوب على أن الحكم الصادر عن محكمة التمييز بإمارة دبي "يمثل نقطة تحول في نظام القضاء" في واحدة من دول الخليج

إنجاز يسطر في ذاكرة التاريخ، تحقق في مطلع هذا العام عندما تمكن المهندس الإسباني بورخا برانانوفا المقيم في إمارة دبي بأن يحكم القضاء الإماراتي بحقه في الحضانة المشتركة للأطفال، حيث يمثل هذا الحكم الأول من نوعه في العالم العربي. استطاع المذكور الحصول على هذا الحكم بمساعدة المحامين، الإماراتي مختار غريب والسوري أحمد الرجوب، حيث عرضا أثناء اللقاء الصحفي الذي انفردت به جريدة بريد الخليج تحليلاً بشأن تفاصيل الحكم ومداخلاته في فقه الشريعة الإسلامية

أكد أحمد الرجوب أن قضية الإسباني بورخا برانانوفا تركت "أثراً بالغ الإيجابية" في كيفية التعامل مع إحدى الحالات التي طالما أفرد لها هو وشريكه مختار غريب مجهوداً كبيراً على مدار مسيرتهما المهنية، ألا وهي إعطاء مصلحة القصر المكانة المستحقة في النزاعات الأسرية. وأضاف: " أنا على يقين بأن هذا الحكم سوف يمثل تحولاً في مسار النظام القضائي لمحاكم دولة الإمارات العربية المتحدة فيما يخص حق حضانة الأطفال

في عام 2013 تزوج بورخا برانانوفا بدولة الإمارات العربية المتحدة من جنوب أفريقية، نتج عن هذا الزواج طفلان. وبعد مرور ثلاث سنوات تقدمت الزوجة برفع دعوى طلاق وبدأت على إثرها نزاع قضائي امتد لسنوات بشأن حضانة الأولاد. تمكنت طليقة بورخا برانانوفا من الحصول على حكم من محكمة دبي الابتدائية يقضي لها بحق الحضانة، عملاً بما ينص عليه التشريع الإماراتي

 بصدور هذا الحكم، أدرك بورخا برانانوفا بأن عليه الدخول في صراع حتى يتكمن من أن يطبق التشريع الإسباني باعتبار جنسية الأطفال. استطاع بمساعدة مختار غريب وأحمد الرجوب أن تحكم محكمة التمييز لصالحه وذلك بإصدارها قراراً غير مسبوق في أروقة القضاء الإماراتي يمكنه من حق الحضانة المشتركة

الشريعة الإسلامية كونها مصدراً للتشريع لا تمنع تطور الأحكام الخاصة بحضانة الأطفال كما أن جميع الأديان السماوية تنص على حماية القصر ورعاية مصالحهم

صرح المحامي السوري بأنهما أدركا منذ اللحظة الأولى لقبولهما الدفاع عن المهندس الإسباني بأنه "يختلف عن باقي العملاء" حيث أظهر بورخا برانانوفا "اهتماماً فوق العادة" بخصوص القضية. وقال مختار غريب: "لعب بورخا برانانوفا دوراً محورياً بتقديمه العديد من الوثائق لإقناع المحكمة بأن التشريع الإسباني يعطي أولوية للحضانة المشتركة

لقد خاضا مهمة "شاقة"  اعتبراها "تحدياً كبيراً" حيث كان تحت تصرفهما "صناديق كبيرة" ممتلئة عن آخرها بالوثائق التي انخرط في إجرائاتها كافة العاملين بمحكمة الأسرة الإماراتية، حسبما ذكر مختار غريب، مدير مكتب المحاماة

وأضاف المحامي الإماراتي: "بدت لي القضية كفرصة استطع من خلاها تحقيق شغفي الشخصي بتغيير إحدى مواد قانون الأحوال الشخصية الإماراتي". صارع أحمد الرجوب لفترة امتدت لأعوام حتى لا يعاني الطفلان بقدر المستطاع كثيراً من إجراءات طلاق الأبوين

ولد مختار غريب في عام 1968 بإمارة دبي، حيث اهتم منذ بداية نشاطه المهني بالحقوق الأسرية. يمثل مختار غريب أحد أعضاء جمعية حقوق الإنسان بدولة الإمارات العربية المتحدة، حيث برز بدفاعه عن الحقوق التاريخية وتمكن من الانتصاف في مجموعة أحكام غير مسبوقة في العالم العربي، مثل قضية حضانة الأب بالتبني والتي صدر في حقها حكما غير مسبوق يعترف بحق الأب المسيحي كوالد لابن نتاج زواجه بمسلمة

في الوقت الحالي، يكفل القضاء الإماراتي للأم الحق في حضانة الأطفال القصر حتى بلوغهم 11 سنة، في حالة الذكور، و 13 سنوات في حالة الإناث، تنتقل بعدها الحضانة للأب. يحق للأب رؤية الأولاد فقط خلال ساعات قليلة كل أسبوع أو أسبوعيين.وعند انتقال الحضانة للأب يحدث نفس الشيء مع الأم حيث يحق لهارؤية الأولاد خلال بضع ساعات فقط كل أسبوع

نحن على قناعة بأن تحمل  مسؤولية الأطفال يجب أن تكون مشتركة بين الوالدين

يرى مختار غريب وأحمد الرجوب بأنه يجب تعديل مثل هذه الأحكام. وأكد المحامي السوري قائلاً: "نحن على قناعة بأن تحمل مسؤولية الأطفال يجب أن تكون مشتركة بين الوالدين" وأضاف المحامي الإماراتي قائلاً: يعد هذا الأمر حقاً أساسياً من حقوق الطفل"

يكمن السر وراء نجاح هذه القضية فيما أثبته المحاميان من أن مفهوم الحضانة المشتركة على الرغم من عدم تماشيه مع التشريع المتعارف عليه في القضاء العربي لكنه لا يتضارب مع أحكام الشريعة الإسلامية المقدسة. لذا، دافعا عن إمكانية إصدار الحكم بحق الحضانة المشتركة كونها منصوص عليها أيضاً في التشريع الإسباني، الأمر الذي يجب النص عليه أيضاً في التشريع الإماراتي لعدم تناقضه مع الشريعة

وأوضح مختار غريب أنه لابد من التفريق بين أحكام الشريعة التي نص عليها صراحة القرآن وتعاليم الرسول وبين الفقه الذي يتمثل في أي حكم يصدر عن أي شخص مسلم والذي -حسبما ذكر- "يمكن تضعيفه أو إثبات خطأه وعدم الأخذ بديمومة العمل به لأنه بالنهاية يعكس رأي فرد تم الأخذ به والعمل بمقتضاه في ظل ظروف معينة خاضعة للتغيير". وضرب مختار غريب أمثلة على هذه الأحكام من ضمنها قانون رقم 28 لسنة 2005 أحوال شخصية والذي ينظم حق حضانة الأطفال في الإمارات العربية المتحدة

النقاش دائما ممكن طالما يهدف إلى إرساء أحكام تتوافق مع الظروف الحالية للمجتمع في إطار الشريعة السمحة والقوانين والاتفاقات الدولية التي وقعت عليها دولة الإمارات العربية المتحدة تحت مظلة منظمة الأمم المتحدة

وأوضح أيضاً قائلاً: "الحق مكفول لمناقشة التشريعات طالما يهدف ذلك إلى إرساء أحكام تتوافق مع الظروف الحالية للمجتمع في إطار الشريعة السمحة والقوانين والاتفاقات الدولية التي وقعت عليها دولة الإمارات العربية المتحدة تحت مظلة منظمة الأمم المتحدة"

وأكد مختار غريب قائلاً: " قانون الأسرة لا يتضمن أحكاماً نهائية فصلت فيها الشريعة فيما يخص مسائل الحضانة" وأضاف: "الشريعة الإسلامية كونها مصدراً للتشريع لا تمنع تطور الأحكام الخاصة بحضانة الأطفال كما أن جميع الأديان السماوية تنص على حماية القصر ورعاية مصالحهم

وعليه، يؤكد المحامي قائلاً:"يجوز أن تتغير مثل هذه الأراء والاختلافات كما يمكن تعديلها بما يتلائم مع الحالة الراهنة، حيث أن سيادة الأخلاق أوسع من سيادة القانون، إن المناعة الحقيقية للشعوبتتمثل في الأخلاق والمعاملة الحسنة والسعادة

ويخلص مختار غريب قائلاً: "يجب أن يرتكز أي قانون يسري العمل به على مبادىء النزاهة والشفافية والكرامة والعفو وإسداء المعروف والتضامن والتراحم والصراحة بين الوالدين، الأمر الذي سيُشعر الجميع بالسلام والاستقرار النفسي وخصوصاً الأطفال

وأشار مختار غريب في حديثه قائلاً: "يعرف الجميع جيداً أن دولة الإمارات العربية المتحدة تولي اهتماماً بالغاً للأسرة سواء أكانت إماراتية أو مقيمة على أرضها، حيث أنها تعتبر الأسرة نواة المجتمع وتسعى دائماً لتحقيق العدالة الأسرية فيما يخص النزاعات القضائية". يعد هذا هو السبب الذي من أجله تمنح الدولة الأجانب الحق في تطبيق التشريعات المعمول بها في بلادهم فيما يختص بالنزاعات الأسرية، حيث كان هذا الأمر فاصلاً في إنصاف هذه القضية

أصداء واسعة

 يرى المحاميان أن نجاح القضية سوف يكون له أصداءً واسعة في المستقبل، حيث قال مختار غريب "من الممكن جداً الاستفادة من هذا الحكم –كونه مدعوماً من قبل محكمة التمييز التي تعد السلطة القضائية العليا في دبي- في سائر القضايا التي تعرض على المحاكم في دولة الإمارات العربية المتحدة

وبالفعل، وضمن خطوة أخرى نحو الأمام يسعى المحاميان لطلب حق الحضانة المشتركة في قضايا تخص مواطنين عرب على الرغم من عدم وجود مواد قانونية في شأن هذا الأمر في التشريع الإماراتي. يستند مختار غريب وأحمد الرجوب إلى إحدى المواد الواردة في القانون بهدف الوصول إلى مسعاهم، حيث تنص هذه المادة على أنه على القاضي إصدار الحكم بما يتماشى مع مصلحة القصر في فترة حضانته

يعد هذا الحكم الصادر بحق الحضانة المشتركة لصالح بورخا برانانوفا "مفهوماً جديداً" -حسبما ذكر أحمد الرجوب- يجب تبنيه في القضايا المستقبلية. وبالفعل ينتظر المحاميان الحكم في قضية يعتقدا بإمكانية تطبيق مثل هذا الإجراء استناداً إلى دفوعاتهما. وعلى الرغم من ذلك، يعي المحاميان من أن الحصول على أحكام تقضي بحق الحضانة المشتركة "يعد أمراً قليل الاحتمال نظراً لقلة الثقافة بشأن الحضانة المشتركة في الأوساط القضائية والمجتمعات العربية  

وفي هذا الصدد، يشير المحاميان إلى أن غياب المرجع في شأن الحضانة المشتركة في قانون الأحوال الشخصية كان السبب وراء عدم حكم المحكمة الابتدائية بحق الحضانة المشتركة. وأوضح أحمد الرجوب قائلاً: "يبرهن هذا الحدث على حاجة القوانين العربية إلى أحكام قانونية تعمل على تنظيم الحضانة المشتركة بين الوالدين عقب الطلاق

لابد من الاستفادة من هذا الحكم –كونه مدعوماً من قبل محكمة التمييز التي تعد السلطة القضائية العليا في دبي- في سائر القضايا التي تعرض على المحاكم في دولة الإمارات العربية المتحدة

 كان أحمد الرجوب على دراية بالأحكام القانونية الإسبانية التي تخص الحضانة المشتركة وذلك حتى قبل توليه الدفاع عن قضية بورخا برانانوفا. في عام 2011، عقب الأزمة السورية التي تحولت إلى صراع مسلح، عمل أحمد الرجوب مع مؤسسات خيرية لمساعدة الأسر المتأثرة بالحرب في حلب وانتقل في عام 2015 إلى دولة الإمارات العربية المتحدة حيث بدأ العمل مع مختار غريب. ألف المذكور كتاب "أحكام الحضانة في القوانين العربية والاجنبية" حيث تناول بالتحليل 19 نموذجاً لمواد تختص بالحضانة في القوانين العربية ونموذجان من القوانين الأجنبية من بينهم القانون الإسباني

ينادي أحمد الرجوب في عمله المذكور بأنه: "على الأباء والبلدان إسداء الاهتمام للأطفال القصر والعمل على سن قوانين جديدة ومحدَّثة لصيانة حقوقهم ومصالحهم على نحو أفضل". علاوة على ذلك يُظهر الكتاب النقاط الإيجابية في قانون الإمارات العربية المتحدة ويبرز من بينها النص القانوني الذي لعب دوراً حيوياً في نجاح قضية بورخا برانانوفا، ألا وهو حق الأجانب في مطالبتهم المحكمة بتطبيق القانون المعمول به في موطنهم بشأن النزاعات الأسرية

يعرف الجميع جيداً أن دولة الإمارات العربية المتحدة تولي اهتماماً بالغاً للأسرة سواء أكانت إماراتية أو مقيمة على أرضها، حيث أنها تعتبر الأسرة نواة المجتمع وتسعى دائماً لتحقيق العدالة الأسرية  فيما يخص النزاعات القضائية

ويراهن المحامي السوري على أهمية إرساء "ثقافة جديدة -خصوصاً في البلاد العربية- حول مفهوم الحضانة بما يتبلور في السعي لما أهو أفضل لمصلحة الأطفال القصر دون محاباة لأحد الوالدين إلا بما تقضيه مصلحة الطفل

ويذكر أحمد الرجوب من بين هذه المظاهر المختلفة التي تقتضي المراجعة قائلاً " يجب أن تُعَّدل الأحكام الخاصة بزيارة الوالدين لأبنائهم  حيث أنه بحسب القوانين المعمول بها حاليا يكون للوالد الذي لم يحكم له بالحضانة الحق في ساعات قليلة كل أسبوع لزيارة أبنائه، وعلى نفس الشاكلة يمكن أن تحرم القوانين الحالية الأم من أبنائها في مرحلة سنية معينة، حيث يصبح لها فقط الحق في رؤيتهم خلال ساعات قليلة

وعلى الرغم من أنه وجد اختلافات بين التشريعات العربية التي تناول تحليلها في دراسته، خلص المحامي قائلاً: "تتقيد جميع تلك التشريعات في الأحكام التي تصدرها في مظاهر عدة وأحيانا لا تسمح بإصدار قرارات تتماشى مع مصلحة الطفل

وعليه، يرى أحمد الرجوب أنه: "تعتبر التشريعات الأوروبية أكثر ملائمة في سماحها للقاضي إصدار حكم يتماشى مع مصلحة الطفل". ويضرب المثل بالقانونين الفرنسي والإسباني "حيث أنهما لا يميزان بين الأب والأم عند إصدار حكم بحق الحضانة، باستثناء الأمور التي تقتضي الأصلح للأطفال

وعلى الرغم من وعيه بالمصاعب التي تحيط بمثل هذه الأحكام إلا أنه يرى الأمل في المستقبل حيث يقوم بإعداد كتاب آخر يتعمق فيه حول مسائلة الحضانة المشتركة. ويؤكد أحمد الرجوب قائلاً: "حصل الكتاب الأول على دعم معنوي كبير من جانب السلطات القضائية والقانونية والحكومية كما حاز على إعجاب بما يطرحه من أفكار من شأنها تحديث الأحكام الخاصة بالحضانة". وبالفعل حصل العمل على اعتماد السلطات الرسمية في الإمارات العربية المتحدة وسوريا لطباعته وتوزيعه

أحمد الرجوب: "على الأباء والبلدان إسداء الاهتمام للأطفال القصر والعمل على سن قوانين جديدة ومحدَّثة لصيانة حقوقهم ومصالحهم على نحو أفضل

لم يكن النجاح التاريخي الذي تحقق في ساحة القضاء الإماراتي هو وحده المكافأة التي حصل عليها أحمد الرجوب  ومختار غريب بدفاعهما عن قضية بورخا برانانوفا، فقد يضاقترح الاتحاد الإسباني لرعاية مصالح الطفولة ترشيح بورخا برانانوفا وفريق المحاماة لجائزة أميرة أستوريس للتعاون الدولي وذلك بمناسبة الحصول على الحكم الأول من نوعه بخصوص الحضانة المشتركة. وفي ذلك الصدد، علق أحمد الرجوب ومختار غريب بقولهما: "أسعدنا الخبر وأثبت لنا أن ثمة أشخاص يقدرون المجهودات الكبيرة التي تبذل

وبعد الحصول على حضانة الأطفال تمكن بورخا برانانوفا من أن يكون أكثر قرباً من تحقيق واحدة من أكبر أمنياته منذ ولادة أبنيه، ألا وهي السفر برفقتهما لقضاء أجازته في إسبانيا. وحتى هذه اللحظة لم يتمكن من الحصول على تصريح للقيام بذلك، لكن يعتقد محامياه أنه لن يواجه عراقيل في حصوله على الضوء الأخضر لتحقيق أمنيته. حيث يرى مختار غريب أنه بعد أن خسرت الأم القضية "سوف تكون أكثر مرونة للوصول إلى إتفاق بين الطرفين لتوزيع أيام الحضانة والرحلات بينهما
